Granted there's a lawsuit that might not be settled for another year, and that no company has been eager to fund 3D Realms, take the following news with more than a grain of salt so it won't leave a bad taste of (bull)shit in your mouth.
As for the future of Duke Nukem Forever, despite what others are writing it may not be over. Our sources suggest that the company may be looking for a partner to take on the unfinished development and continue to push the game forward toward release, and 3D Realms would at least be a part of this process.
